Terms and Conditions for Expert Witnesses Professional Services

These Terms and Conditions ("Terms") govern your use of the services offered by Courtpals LLC, acts as a bridge and liaison between Attorneys and Experts, connecting Attorneys who require the services of Experts for Expert Affidavits and Court Appearances with qualified Experts in the field. By using our services, you agree to be bound by these Terms.

SERVICES:

Courtpals provides to Attorney, and only Attorney, the following professional services:

Search and selection of qualified Experts in the area of Expertise the Attorney requested for Expert Affidavits and Court Appearances.
Coordination between the Attorney and the Expert for the preparation of the Expert Affidavit and Court Appearances.

YOUR OBLIGATIONS:

You agree to provide Courtpals with all information necessary for the search and selection of the appropriate Expert, including information regarding the case, the subject matter of the case, and deadlines.
You agree to provide Courtpals and the Expert with access to all documentation relevant to the case.
You agree to maintain the strictest confidentiality of all information provided by Courtpals, including, but not limited to, information regarding the Experts and the legal strategy of the case.
You agree to pay Courtpals the fees set forth for services rendered.
You agree to restrict from contacting the Expert by any means other than through official channels provided by Courtpals.
You agree to inform Courtpals in a timely manner of any developments regarding the case or any issues with the Expert so that Courtpals can take action and resolve the matter in the best interests of the client.
You agree that Courtpals is not responsible for any failure of the attorney to communicate to Courtpals about any eventualities or problems with the Expert.

COURTPAL’S OBLIGATIONS:

Courtpals commits to:

Search for and select qualified Experts in the area of Expertise requested by the Attorney for Expert Affidavits and Court Appearances, according to Attorney's specifications.
Coordinate between the Attorney and the Expert for the preparation of the Expert Affidavit and Court Appearances.
Ensure that the Expert complies with his or her obligations under the Expert Agreement.
Maintain the confidentiality of all information provided by the Lawyer.
Provide the Attorney with all information necessary to make informed decisions about the choice of the Expert and the legal strategy of the case.

Confidentiality:

The Attorney and Courtpals agree to maintain the confidentiality of all information to which they have access during the term of the commercial relationship, including, but not limited to, information regarding the cases, the Experts and the legal strategy of the case.

Indemnification:

The parties agree to indemnify and hold harmless the other party from any damage, loss or liability arising as a result of a breach of their obligations under these Terms.

Governing Law and Jurisdiction:

These Terms shall be governed by and construed in accordance with the laws of California, United States. Any dispute arising out of these Terms shall be submitted to the exclusive jurisdiction of the competent courts of California, United States.

Waiver:

The failure of either party to require strict performance of any provision of these Terms shall not be construed as a waiver of its right to require performance of such provision or any other provision hereof in the future.

Invalidity:

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed from the Terms and the remaining provisions shall remain in full force and effect.

Acceptance:

By using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

EXHIBIT 1

Tarifas:

Expert Affidavit: $2,999
Court Appearance: $1,999
Payment to the Expert: Courtpals will arrange for payment to the Expert in accordance with the rates set forth in the Confidentiality Agreement and Professional Services Agreement between Courtpals and the Expert.

Expert Affidavit: $2,999

Court Appearance: $1,999

Payment to the Expert: Courtpals will arrange for payment to the Expert in accordance with the rates set forth in the Confidentiality Agreement and Professional Services Agreement between Courtpals and the Expert.

Method of Payment:

Attorney shall pay Courtpals the fees set forth in Exhibit 1 of this Agreement via stripe.
